Instruction permit rules
- A licensed supervising driver sits in the front passenger seat: 21 or older if you're under 18, 18 or older if you're 18 or over.
- Everyone in the car wears a seat belt or the right child seat.
- Under 18, no phone use while driving, with or without hands-free.
- Carry your permit every time you drive. Driving to practice without a valid permit is illegal.
- The permit lasts two years. If it's lost or runs out, apply for a new one, which is good for two years from that day.
Provisional license limits
| First 6 months | Months 7 to 12 | |
|---|---|---|
| Night driving | Not from midnight to 5 a.m., with exceptions | No limit listed |
| Passengers under 20 | One, unless a parent or guardian is in the car | Up to three, unless a parent or guardian is in the car |
| Phones | None, even hands-free | None, even hands-free |
Immediate family members under 20 don't count toward the passenger limit. The night exceptions are driving with a licensed driver aged 25 or older, between home and work, between home and a school event the school doesn't provide transportation for, or for your job.
Vanessa's Law
If an unlicensed teen is convicted of a crash-related moving violation or an alcohol or drug violation, they can't get a permit or license until 18. A provisional license holder who loses their license for those reasons can't get it back until 18 or until the withdrawal period ends, whichever is longer. Getting it back then usually means a $680 reinstatement fee, the written test, a 30-hour classroom course (not online) and six hours behind the wheel.
